Data for Academic Research Product-Specific Terms of Service
These Data for Academic Research Product-Specific Terms of Service are incorporated into and form part of the General Terms of Service between Customer and Lightcast. They apply specifically to Customer’s use of the Content for academic research and publication purposes. In the event of any conflict between these Data for Academic Research Product-Specific Terms of Service and the General Terms of Service, these Data for Academic Research Product-Specific Terms of Service will control with respect to the subject matter set forth herein.
1. Permitted Use
1.1. Unless otherwise set forth in an Order Form, Customer may use the Content as an analysis tool to support the publication of one (1) academic article published by Customer and any named coauthors on research projects using the Content.
1.2. If possible, the authors and coauthors involved in the publication must be identified in writing to Lightcast at the outset of the research project.
1.3. For clarity, the Term specified in the Order Form does not govern the publication date of the academic article.
1.4. Lightcast and its Applied Research team shall have the right to review and comment on any publication or media release that contains data or analysis derived from the Content. Customer must provide Lightcast with at least thirty (30) days’ advance notice prior to such publication or release for review purposes.
2. Data Sharing Restrictions
2.1. Customer may share the Content or any portion thereof only with coauthors or assistants who have a need-to-know and whose access is specifically and directly related to the research and/or publication of the academic article.
2.2. Customer is responsible for ensuring that any individual with whom the Content is shared complies fully with these Data for Academic Research Product-Specific Terms of Service, including the Data Destruction obligations in Section 3.
3. Data Destruction
3.1. Customer shall erase and destroy its copy of the Content, and any reproductions or parts thereof, within two (2) months of publication of the academic article or upon termination of the Agreement, whichever is later.
3.2. Customer shall also ensure the erasure and/or destruction of all copies, reproductions, or parts thereof that were provided to any third parties, including coauthors or affiliated institutions.
3.3. Data destruction must be complete, leaving no data readable, decipherable, or recoverable on any computer systems or storage media.
3.4. Upon request, Customer shall certify such erasure and destruction to Lightcast in writing.
3.5. Notwithstanding the foregoing, Customer may retain one (1) copy of the Content solely for the purpose of defending the research and/or publication of the academic article.
